First Aussie Spammer Cops Heavy Fine
Posted on October 31st, 2006 by David GaltNews this week in the online world is that Wayne Mansfield who used to promote seminars using SPAM has been fined $1 million personally and his business, Clarity1, has been fined a further $4.5 million for breaches of the SPAM Act.
That’s a lot of moolah in anyone’s language.
He has been the subject of SPAM complaints for a long time. I remember talking with Wayne when we put on the X10 Seminar - we received a proposal from him and turned it down as it is sudden death for an online business to be associated with a known spammer.
It was clear to see that the Federal government wanted to make an example of Wayne and his business practices. No matter what appeal he lodges, no matter which law firm he chooses, Wayne’s up shit creek without the proverbial pole.
The above news prompted one of our email marketing clients to request a meeting to ensure their compliance with the Spam Act. This shows great initiative and every online business should regularly audit their compliance, as harsh penalties apply for non-compliance.
This is a timely reminder to use good email marketing software, which has inbuilt SPAM assistance. By this I mean it should include some of these options…
- Double opt-in
- Confirmation of subscription
- Automatically insert unsubscribe link in every email (CAN SPAM compliance requirement)
- Automatically insert your physical address (CAN SPAM compliance requirement)
- Provides guidance on the SPAM rating of your email
- Have controls over importing databases…
We use and recommend EBI-Mail as our email marketing platform and have some very big name clients who use the service daily and send large amounts of email without hassle.
